Speeding ticket dismisal?

I got a speeding ticket a lil over a month ago and im supposed to appear before the 26th. So ive been to the court house twice and they still dont have my ticket in the system so yesturday i called them and they said for me to call on the 26th and if it isnt in the system on the 26th then bring my copy of the ticket in and they will put it on record. Now my question is if i call about it on the 26th and its still not in then can i just not go up there and forget about the ticket so it wont be on my record, i mean to do state troopers have a tendacy to forget to turn tickets in? has this happened to any one else? did u get away with it? BTW i got the ticket in Montgomery County Texas if that helps at all….

It’s very rare that a trooper loses a citation, but it happens. You’re certainly under no obligation to assist the state in prosecuting your case by bringing your copy of the ticket to the court. The best way to go is to come to court with a couple of friends as witnesses on the date and time listed on the ticket. Present the clerk with your driver’s license, and if they cannot find any records, feel free to go home. If the worst comes to worst and the citation does make it into the system sometime afterwards, you’ll be protected against any failure to appear charges.

Previous assault charge in Ohio, and now an assault with a deadly weapon charge in Texas…What will happen?

At 15, my brother received an assault charge (IN OHIO) after fighting another boy at school (he broke the boy’s jaw)…Now at 17, he’s being charged for assault with a deadly weapon (IN TEXAS). The so-called “victim” of the assault was drunk, threatening to kill four other people at the party (himself, too), and had already attempted to attack the four the night before. My brother tried to console him, and the guy pulled a knife on him (cutting my brother’s hand). My brother hit him (with an UNLOADED gun) and knocked the knife out of his hand. Now the “victim” has filed assault with a deadly weapon charges against my brother. How will this turn out in court??? My brother has several MIPs and MICs on his record…And one criminal mischief charge. What may be the outcome of his situation?

It doesn’t look good with the prior charges. But has he been convicted?

Texas is a pretty tough state, and depending on what happened, the statements of witnesses who were there when this happened, it can be tough to prove. Basically everything is based on hearsay and observation, and if others were also intoxicated at the party it can look like there are no reliable accounts of what really happened – meaning, his word against the victim. He might get in trouble for having a gun at a party, unless he has the license to own it.
Your brother needs an attorney for this. The prior troubles aren’t going to help with this, but if you guys can get reliable witnesses stating what happened that could certainly help him.

What are my rights as a Texas renter if Apartment manager fails to make repairs?

Me and my wife just got married and are now living in an apartment where the apartment manager hires people with criminal records to do repairs. He wants us to be at home all the time when repairs get done and we can’t be there all the time. But that is just one complaint, we have now been living here for two weeks and no appliances work, no washer/dryer, stove, and dish washer which were promised to us weeks ago and manager said he will fix it all before we even moved in and keeps holding it off even further. We haven’t paid rent thus far but have put down our deposit of $300, we have called him several times and still get little or no help. Is this grounds for breaking a lease and also for a court action if leasor doesn’t obide by the terms of lease in which they do repairs and maintenance? What are my legal rights under Texas Law and how can I get something done? I feel that my landlord is being very cheap on us and hiring unprofessional people to do repairs. What can I do?

I am not in Texas, however, generally a landlord should provide a safe and functional place to live. Read over your lease and figure out what you agreed to. Talk to the city you live in, they should have a housing authority and can advice you on the local ordinances.

I wouldn’t sweat it if you need to break the lease. Unless the rental market is very tight, you probably wont have much trouble. Doesn’t sound like its’ very competitive if the landlord allowed you to move in without paying rent.
