I’m not sure what you mean by “pending lawsuit” — having a pending lawsuit is not a crime, in and of itself.
In any case, the TREC hands each case on a case-by-case basis. So depending on your crime as well as any mitigating factors, you might still be able to become licensed even with a criminal record. Obviously, things like the type of crime and/or severity of the sentence play a huge part. For example, felonies are treated more harshly than misdemeanors.
