how can i get my sons father to sign over his parental rights.?
I live in Washington state but im from Maryland, where my son was born. My son ” Jon” is 2 ,1/2 years old, and he hasn’t seen his bio father “Dik” in almost a year and doesnt remember him . I am now married to a wonderful man ” tom” i have been with for 4 years (except the 6 months i was with my sons father) Dik is court ordered to pay child support but in the last 2 1/2 years hes only paid like 6 times. I have begged him to sign over rights. My husband wants to adopt my son so bad and i want Dik out of Jons life until Jon is older. I dont know if it helps but Dik has a child rape, 3 assults on his record, he smokes pot,PCP,E etc… he is 28 and only dates girls under 17 . when i was preg, Dik beat me and threatened to kill me and the baby, i almost lost Jon 2x. I got smart and went back with the man i loved Tom. please tell me how to get his rights taken away, he calls randomly and threatens to kill me and says he going to take my son away. the cops wont help. suggestions?
The courts only believe what they see and hear…get caller id when you see his number hand the phone to your child in a good manner and say your daddy is on the phone/whatever your son knows him as and during visitation if any you do not have to have any contact with the father and you should prefer this because it will make your case stronger. This will make him realize exactly what you feel you dont have to pretend that this situation is ok. But its gonna cost you alot of money unless you contact the red cross for discounted/ any lawyer pro bono prefferably for that particular kind of case. be prepared for the long haul your son is not old enough to speak for himself but he does need you to do it for him sooner than later.
