Is “Quiet Title Action” For Me?

Two years ago I stopped making mortage payments on two houses that I owned because I lost my job and could not afford to continue. Last year I received a letter from the mortgage company stating that they were going to foreclose each house and auction the properties in October 2008.

To date, only the first house was foreclosed. Nothing has been done on the second property. I contacted the mortgage company a few months ago and they said they said that there were notes in the record from the foreclosure attorney stating that he could not foreclose due to a question of ownership. What makes this interesting is that both houses were with the same mortgage conpany.

Someone had told me that there is a way to a sue a mortgage company to give the property back to you, free and clear, after a certain time frame. Any truth to this? Is this considered a quiet title action?

I don’t think a quiet title action is what you are looking at. Loan policy or title policy should deal with ownership issues.
