Ar Records

Someone is in a probation period AR until July and he has H1B visa?

Could company apply for Green card or renew visa before probation time expire and will this fact make problems for obtaining Green card or visa.
How about after July? The attorney explains that AR means that after this period no one will see record about being arrested. Is it true? If after July company will apply for Green card should this person mention in application that he has been arrested?
What has happen with this person doesn’t count as crime in his country. it is a cultural thing,
may be I use wrong word. it is not probation, but they say AR. I thik this is somthing else.

A person applying for a Green Card is required to disclose any arrest, regardless of conviction or if the record is later expunged. If you do not disclose the fact, and it is later discovered, you could be stripped of your US immigration status.

That the crime is not considered a crime in a person’s native country has no bearing on the situation – it is not a “cultural thing” – it is a matter of respecting and obeying the laws of the country you are in, especially if you are seeking the privilege of living and working here.
